Contest Period 

The Edvantage “Register & WIN” Contest (the “contest”) begins at 12:01 a.m. Eastern Time (“ET”) on October 1, 2021 and closes at 11:59 p.m. ET on December 31, 2021 (“Contest Period”). 

 

By participating in the contest, each contestant agrees to abide by and be bound by these official rules and all decisions of Edvantage (as define below) which shall be final and binding, without right of appeal, in all matters relating to this contest and the awarding of the prize, including without limitation eligibility and/or disqualification of entries.


Contest Eligibility
This contest is open to all active Edvantage members, at least 18 years of age at the time they enter this contest, or if automatically entered as of the start of the Contest Period, and resident of Ontario. Employees, directors, trustees and officers of Ontario Teachers Insurance Plan (“OTIP”), Edvantage and their affiliated companies1, (collectively for purposes of this contest, “OTIP”), the prize selection team and members of their respective immediate families and/or anyone with whom the employees, directors, trustees or officers of OTIP/Edvantage are domiciled and are also excluded. 

 

How to Enter 

To obtain entry for a prize, during the Contest Period, contestants must complete the registration process and provide their contact information, being their group name, Edvantage number, first and last name, email address, preferred language and province (“mandatory information”) (collectively, “consent”). Failing to complete the mandatory information means the contestant will not be entered into the contest. To receive entry, contestant must have an active registration/consent as of the Draw Date, as defined below.

 

Contestants who have provided consent/registered prior to December 31, 2021 will automatically receive two entries into the contest. If a contestant does not want to be automatically entered into the contest, they need to click the “I do not want to participate in the contest” button in the email sent to the contestant from Edvantage, or send an email to marketing@edvantage.ca with the subject line “I do not want to participate in the contest” and include their first and last name, group name and Edvantage number, and OTIP/Edvantage will remove any entries the member would have otherwise been eligible to earn in this contest.

 

This contest can only be entered once. Additional entries shall be declared void and the contestant will be disqualified from the contest rendering them ineligible for any of the prizes.  One contestant per e-mail address. To be eligible, entries must be received during the Contest Period. In disputes, entries may be deemed to be made by the authorized account holder of the e-mail address submitted at the time of entry. Authorized account holder is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.

 

Prize Details

There are ten (10) $500 prepaid Mastercards® available to be won.

 

The ten prizes of $500 prepaid Mastercards®, sponsored by Bank of Montreal (“BMO”), will be sent to the winners by courier from OTIP/Edvantage and are non-transferable, non-assignable and non-exchangeable for cash or any other form except at the discretion of OTIP/Edvantage. The use of each prepaid Mastercard® falls under the rules and regulations, terms and conditions of the company issuing the prize as amended from time to time. Bank of Montreal (“BMO”) and OTIP/Edvantage will not be responsible for any lost, stolen, or misplaced prepaid Mastercards® delivered to a winner or for any prepaid Mastercards® that have expired with a balance remaining on them, or for any fees or charges associated with each of the prepaid Mastercards® in any way, unless specified within the prize description. The prepaid Mastercards® will not be replaced, refunded or reimbursed if lost, stolen or misplaced. Purchase amounts that exceed the value of the tendered gift cards will require payment by the winner by some other method for the balance due.

 

Any and all taxes on any prize awarded, including income taxes, and any incidental expenses associated with collection of the prize, are the sole responsibility of the winner. No substitutions will be made for any prize except at the discretion of OTIP/Edvantage who may substitute a prize of equal or greater value in the event any of the contest prizes are no longer available. 

 

Prizes will be delivered to verified winners only to one (1) address in Canada. The prizes shall be null and void if the winners do not accept their prize within 60 days of being confirmed by OTIP/Edvantage as a winner. The prizes are subject to rules, regulations, restrictions, terms and conditions and expiry dates set by the company offering the secondary prizes and the winner of any prize in this contest must agree to abide by those rules, regulations, restrictions, terms and conditions and expiry dates.

 

Winner Selections / Draws     

On or about January 10, 2022 (“Draw Date”), a random draw will be conducted from among all eligible entries received during the Contest Period, for the purpose of selecting ten (10) potential prize winners (subject to satisfying the prize claim conditions below). Odds of being selected depend on the number of eligible entries received during the Contest Period. Winning prize winners will not be eligible for subsequent prize draws.

 

All decisions by the independent prize selection team are final and binding on the participants in all matters relating to the contest. 

 

Prize Claim Conditions 

Selected entrants will be notified by telephone or email at the telephone number or email address provided at the time of entry/during the registration process. In order to be declared a winner, selected entrant must: (i) respond to notification of selection within seven (7) business days of first attempt by OTIP/Edvantage; (ii) correctly answer a time-limited mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise; (iii) sign and return to OTIP/Edvantage a written declaration and release form, releasing OTIP/Edvantage from any liability in connection with this contest or the use, misuse, awarding or possession of any prize (the “Release”); and, (iv) otherwise comply with these official rules.

 

Return of any prize or winner notification as undeliverable, inability to reach selected entrant or failure of selected entrant to respond to notification within seven (7) business days of first attempt by OTIP/Edvantage, failure to provide proof of eligibility (if requested), Release, or other required documentation in a timely manner, failure to correctly answer the skill-testing question, or other non-compliance with these official rules may result in disqualification, forfeiture of the prize and, at OTIP/Edvantage’s sole discretion, selection of an alternate eligible entrant for the forfeited prize in accordance with these official rules, who will be subject to disqualification in the same manner.

 

Selected entrants will be asked for an address to where the skill-testing question, a declaration of compliance with these official rules, Release and their prize can be sent. Post office box addresses are not acceptable as courier companies cannot deliver to box numbers. If the winner resides at a country address and/or a rural route address, the winner may be asked for their emergency-locate address or other identifiable information to assist the courier company with the delivery of the prize. The prize will be delivered to each eligible and confirmed winner approximately 2 weeks after the winner is confirmed save and except for any unforeseen events such as, but not limited to, a weather event, postal or courier strike, flood, fire, war, break out of disease, quarantine, hydro outage, service provider problems.   

 

It is the sole responsibility of any contestant to notify OTIP/Edvantage of any changes to their contact information by emailing marketing@edvantage.ca or in writing: OTIP, c/o Edvantage Marketing Department, P.O. Box 218, Waterloo, ON  N2J 3Z9, if they still wish to be entered into the contest.  

 

Entries and the prize claim are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

 

Right to Void / Terminate / Suspend / Modify

OTIP/Edvantage reserves the right to withdraw, terminate, suspend, cancel, amend or modify all or part of the contest, in any manner and any rule(s) of the contest, at any time and without prior notice, for any reason whatsoever or if it determines that for any reason the contest cannot be run as originally planned, including, but not limited to, technical failure or corruption, computer virus, bugs, computer, electronic or system malfunction, tampering, unauthorized intervention, fraud or any other factor(s) or cause(s) beyond OTIP/Edvantage’s control which in OTIP/Edvantage’s opinions compromise the fairness or integrity of the contest and/or affect the administration, security, or proper conduct of this contest as contemplated by these official rules. Under this section OTIP/Edvantage is not obligated to award any prize to any selected contestant. 

 

If, as a result of an error relating to the entry process, entry, entry count, drawing or any other aspect of the contest, there are more potential winners of the prizes than contemplated in these official rules, there will be a random draw amongst all eligible prize claimants after the Contest Period to award the applicable prize.

 

Limitation of Liability and Releases

By entering, the contestant releases OTIP/Edvantage from any and all liability arising out of, or in connection with, this contest and the awarding of any prize, now or in the future. By entering this contest, the winner consents in writing to the use of their name, city and province where they reside by OTIP/Edvantage in a format approved by that winner, as well as any audio/video image, statements, and/or photographs in any related publicity and publication without further compensation, worldwide and in perpetuity, in any and all forms of media and social media now known or hereafter devised, including, but not limited to, the Internet, Facebook, Twitter, LinkedIn, YouTube, Pinterest, SnapChat and in any publicity or advertising carried out by OTIP/Edvantage, unless prohibited by law. 

 

By entering in the contest, the winner agrees to sign a form of declaration confirming compliance with these official rules and agrees to release, indemnify and forever discharge OTIP/Edvantage and their affiliated companies, directors, trustees, officers, employees, the prize selection team and any of their parents, affiliates, agents, and contractors, BMO. and any advertising and promotional agencies whether for the contest and/or the prize, and all their directors, trustees, officers and employees, from any and all action, proceedings, suits, liability, losses, costs, expenses (including legal fees and disbursements), damages, demands and claims of any kind, in respect of anything done by OTIP/Edvantage and/or BMO. in the performance of their duties hereunder in connection with the contest and/or resulting from the acceptance, possession or use of a prize or any part of a prize or any extension to a prize, including without limitation, but not limiting to, any loss, personal injury, death, disablement, dismemberment, property, home or vehicle damage, or claims based on publicity rights, defamation or invasion of privacy that could result from, but not limited to, the awarding or use of any prize, by signing an Agreement / Release Form as a condition to and in advance of receiving their prize in favour of OTIP/Edvantage and neither OTIP/Edvantage or any company providing the prizes in this contest, including BMO, will not be liable for the use or misuse of the prize. OTIP/Edvantage assumes no responsibility for the participation in the contest or any liability, claims, demands, actions, loss, damage or personal injury that may be sustained by the contestants, the winner and/or the person(s) sharing the winner’s prize. The provisions of this section shall survive the termination of this contest and may be relied upon by the parties hereto at any time.

 

Protection of Personal Information and Publicity Release

By entering this contest, contestants agree to the use of their personal information in accordance with the Privacy Policy regulating Edvantage at https://edvantage.ca/privacy. When contestants participate in a contest, OTIP/Edvantage may keep a record of the information, response or any opinion volunteered without reference to their identity to calculate the contest results on their respective websites or in other media such as business documents or leaflets sent to members. Collection of information, including name and e-mail address under this contest is strictly for the purposes of administering this contest. OTIP/Edvantage will use personal information the contestant submits for the purposes of contacting a contestant and awarding a prize in the contest should the contestant be selected as a winner. 

 

OTIP/Edvantage reserves the right to post or publish any winner’s name, city, or province of residence, photograph, likeness, voice or other statements, as directed by the winner, on its website and/or on the website of OTIP/Edvantage’s affiliated companies and/or on the sponsor’s website for advertising and promotional purposes, where lawful, without further compensation to the winner. By entering the contest, contestants who win any of the prizes, agree to have their names published; however, the identities of contest winners and other personal information are never published without their written consent. Personal information will not be shared with outside parties.

 

General Conditions

This contest is subject to all applicable federal, provincial, territorial and municipal laws and regulations, is void where prohibited by law and is governed by Canadian laws and the laws of the Province of Ontario. If any provision of these official rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.

 

By participating in this contest, contestants agree to be bound by these official rules and the rules and regulations set out by the prize providers. 

 

OTIP/Edvantage will not be held responsible for any errors or negligence that may arise or occur in connection with the contest including, but not limited to, the contestant’s information (whether it be mandatory information or optional information) entered into the contest by any person, including, but not limited to, a customer service representative.     

 

All entries become the property of OTIP/Edvantage upon receipt and will not be returned. 

 

Failure to comply with these official rules may result in disqualification from the contest at any time. OTIP/Edvantage’s failure to enforce any term of these official rules shall not constitute a waiver of that provision

 

OTIP/Edvantage is not responsible for any entries that are lost, late, damaged, destroyed, corrupted or misdirected, incomplete, garbled, or delayed by or on any computer, online telephone or technical malfunctions that may occur in the processing transmission or receipt of entries.

 

OTIP/Edvantage reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate or necessary to comply with applicable law.

 

OTIP is not responsible for any theft, destruction or unauthorized access to, or alteration of, entries; failures or malfunctions of electronic data transmission, telephones, telephone lines or telephone systems, interrupted or unavailable network, server or other connections, any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to the participant’s or any other person’s computer related to or resulting from participation in this contest; the cancellation, suspension or preemption of games, injuries or timing errors, electronic or equipment failure or other communication problems occurring in connection with participation in this contest nor is it responsible for any transmission of viruses from any OTIP/Edvantage website to a computer system or if any whole entry system crashes resulting in the contest being cancelled or other problems or errors of any kind whether mechanical, human, electronic or otherwise.

 

OTIP, Edvantage, the prize selection team, BMO and any of their parents, affiliates, agents, and contractors, including advertising, sponsoring and promotional agencies, and their directors, trustees, officers and employees expressly disclaim and shall be held free of all responsibility or liability for any loss or damage in respect to any prize howsoever caused, any act, error, omission, injury, loss, accident, delay or the neglect or default of any company or person providing any service for the contest, whether through providers negligence or otherwise, or due to cancellations, adverse weather conditions, loss of personal belongings, illness, bodily injury, accident, death, deterioration of services, inconvenience, loss of enjoyment, disappointment or frustration, either mental or physical due to any Acts of God, force majeure or third party wrong doing, epidemic, social or political disturbances or due to any cause whatsoever occurring during the contest and the use of the prize by the winner or person(s) sharing any winner’s prize.

Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws. Should such an attempt be made, OTIP (as defined above) reserves the right to seek damages from any such contestant to the fullest extent permitted by law.
